Thai SEC Seeks Comments on Digital Asset Derivatives Rules
Thailand’s Securities and Exchange Commission (SEC) has opened a public consultation on a draft framework under which derivatives contracts could be based on digital assets. The plan sets out what derivatives exchanges, clearing houses and intermediaries would need in order to be licensed, according to a SET News release dated 31 October that Thailand Business News carried on 1 November.
The package consists of eight draft notifications. Among other things, they would amend the criteria for granting licences and update the financial reporting rules that derivatives exchanges and clearing houses must follow. Companies running digital-asset businesses could apply for a derivatives licence through their existing company instead of forming a new one, placing both activities under a single set of rules. An earlier round of public hearings ran from April to May 2026, and according to the SEC, most stakeholders agreed with the approach in principle.
The SEC said the changes are intended to let investors use regulated derivatives that reference digital assets to manage portfolio risk, and to align Thailand’s derivatives market with international standards. The consultation is open until 28 November 2026, with comments accepted through the SEC website, Thailand’s Legal Hub or email.
